Kohberger hearing leaves more questions than answers
BOISE, Idaho (CBS2) — Bryan Kohberger was in court on Wednesday afternoon for a hearing on several motions, including whether or not the trial will be held in a different venue.
A seemingly frustrated Judge Judge questioned whether or not the trial needed to actually be scheduled nearly a year and a half out, in the summer of 2025. He mentioned more than once that thinking that far ahead is difficult to wrestle with but that he is listening closely to both sides to make the best determination for everyone. The consistent theme from all sides Wednesday was "We only want to do this once."
Kohberger's defense team says that they have yet to receive a significant portion of the discovery that the State is required to turn over and that scheduling anything at this point is premature without getting a full look at the scope of what the defense team is facing.
The State pressed the Judge to set a deadline sooner rather than later to present the alibi defense that Kohberger's team had promised is coming. A presentation at a previous hearing on the alibi defense could essentially be summed up as follows; Kohberger was driving alone at night. The State said as much on Wednesday when asking the Judge to set a firm deadline. The defense argues that they need more of the discovery turned over so that their investigator can piece together the necessary information to establish the alibi defense. The Judge and State both seemed confused, stating that is not how alibi works.
After more than an hour of deliberation, the court decided to set a date to set a date. The battle over timeliness for the trial for everyone involved against allowing enough time for preparations to be made continues to sit front and center.
